Statement of the Medical Society of the State of New York on the Medicaid Redesign Team Report and its Inclusion in Governor Cuomo’s Proposed 2011-2012 Budget

The Medical Society of the State of New York will support the report of the Medicaid Redesign Team, as incorporated into Governor Cuomo’s Budget Amendments, if, and only if, the Medical Liability Reform proposals remain intact. The Medical Society of the State of New York has decided to support this Report for one overriding reason –Medical Liability Reform. Medical liability reform is the linchpin of successful reform; Medical Liability Reform is Medicaid Reform. Without Medical Liability Reform, specifically, the $250,000 cap on non-economic damages, the Re-design Plan is not sustainable. Without medical liability reform, the Medical Society will not support this report.

Like many of our colleague organizations, the Medical Society of the State of New York has concerns with some of the recommendations in the Report. We will continue to advocate for the physicians and patients of New York State. We will seek changes in the Medicaid program to address inadequate physician payments; unwarranted non-physician scope of practice expansions; and insurer surcharges on payments for physicians’ services. We look forward to working with Governor Cuomo, the Legislature, and other like-minded organizations to achieve meaningful medical liability tort reform and Medicaid reform.

Medicaid Redesign Team Makes Historic Recommendations

HISTORIC PROGRESS MADE IN REFORMING MEDICAID IN NEW YORK STATE

New York spends more on Medicaid per capita than any other state in the nation, but we rank only 21st in program quality for patients. In most counties, Medicaid costs alone account for more than half of the entire county tax levy.

To reform the system, Governor Cuomo created a Medicaid Redesign Team. The Team — comprised of health care professionals, stakeholders, and legislators — was charged with reducing costs and improving patient care. The Team held open meetings throughout the state and reviewed more than 4,000 ideas from team members, outside health care professionals, and citizens.

Last week, the Team accomplished their goal, submitting an unprecedented consensus plan that meets the Governor’s budget target and saves over $2.3 billion. What’s more, under the plan, one million New Yorkers will now have access to an innovative “patient-centered” medical program, making New York the national leader in providing this type of personal care. Today, the legislation to enact the plan was submitted to the Legislature to be included as part of the Executive Budget.

A REALLY Useful WC Page!

Dear Doctors,

For those of you (or your office staffs) who are dealing with Workers’ Compensation patients, the following web page should be really really useful.  It will help to inform you of who is handling variance requests at the WC carrier involved in your patient’s case.  It will tell you which carriers are participating in the Optional Prior Approval Process, whereby you would file the MG-1 Form.  In addition, it will identify who should receive your request for authorization (C-4 auth Form) at the WC Carrier.  The page also will identify which WC Carriers have chosen not to participate in the optional Prior Approval Process.

In the third paragraph on the page, you or your staff will be able to link to a component that will help you find the WC Carrier for the employer – just in case you don’t have that information.

Nassau County DoH Issues Measles Alert

Feb. 2, 2011: Nassau County Department of Health today announced that a case of measles has been confirmed in the county. The individual recently traveled internationally to areas with widespread measles.  Residents may have been exposed to the case if they visited:

January 20 (Thursday) from 3pm to 10:30pm

1) Report all suspect measles cases immediately (DO NOT WAIT FOR LABORATORY CONFIRMATION) to the Bureau of Communicable Disease Control at 516.227.9496 during business hours or 516.742.6154 evenings, weekends and holidays.

2) Patients with febrile rash illness should notify staff before arriving so that they may be placed in isolation immediately.

3) Offer measles vaccine or immune globulin to susceptible exposed contacts.

4) Assure that all those eligible for MMR vaccine receive appropriate and timely

vaccination.

GOVERNOR CUOMO RELEASES BUDGET TO CLOSE $10 B GAP

February 2nd, 2011

Governor Cuomo released his proposed Budget for the 2011-12 Budget year which seeks to close a $10 billion budget gap.  The proposed Budget includes all funds spending of $132.9 Billion, or 2.7% ($3.7B) less than the funding allocated for the 2010-11 Budget year.  Notably, the Budget proposal calls for reducing State Funds Medicaid spending by $2.85 billion for the 2011-12 fiscal year, and $4.6 billion for the 2012-13 fiscal year based upon initiatives identified by the Governor’s Medicaid Re-Design Team, and limiting spending growth to the 10-year rolling average of the medical care component of the CPI (currently 4%).

While staff is continuing its review of the Budget bills released by the Governor, among the notable items in the proposed Budget include:

  • Continuing Excess Medical Liability Insurance program for next 3 years

  • Continuing superintendent’s medical liability insurance rate-setting authority for 3 years

  • Continuing $990,000 allocation for MSSNY’s Committee for Physician’s Health

  • Continuing $1.7 million in funding for the physician loan forgiveness program

  • 10% cut to early intervention services

  • Funding for Cancers Services Program is reduced by $650,000 to reflect the elimination of non-direct care components of certain programs. Estimated savings for 2011-12 is $320,000.

  • Restructure the General Public Health Work Program:  Reimbursement for the General Public Health Work program will be limited to basic services and reimbursement for all optional services will be discontinued.   Optional services include Medical Examiners, Early Intervention Service Coordination, Dental Services, Home Health Service, Long Term Care, Emergency Medical Services, other environmental services, radioactive materials licensing, radioactive equipment inspection and housing hygiene.   Estimated Savings for 2011-12 is $10.5 million

  • Would limit EPIC coverage for drugs when an enrollee has entered into the Medicare Part D coverage gap.   Effective July 1, 2011 EPIC enrollees will be responsible for paying Part D premiums or their full deductible.  Produces savings in the program estimated at $58.4 million.

  • No new health care taxes, assessments or fee increases

Annual Wellness Visit Claims

The Centers for Medicare & Medicaid Services (CMS) issued Change Request (CR) 7079 on December 3, 2010, which directed the implementation of Medicare’s annual wellness visit (AWV) under Section 4103 of the Affordable Care Act. Coverage and payment of the AWV were effective January 1, 2011.

Some providers billing for the AWV have included the “routine service” diagnosis code on their claims. Moreover, because Medicare does not pay for routine services, some contractors apply auto-deny edits whenever this “routine service” diagnosis is included on the claim. Consequently, some contractors are denying AWV claims when they should be paid.

CMS has directed contractors to not auto-deny claims for Healthcare Common Procedure Coding System (HCPCS) codes G0438 and G0439 when billed for an AWV in accordance with CR 7079. Based on this direction, National Government Services omitted the editing for diagnosis code V70.0 that is allowable with HCPCS codes G0438 and G0439, and claims that were initially denied are being reprocessed.

COLLECTIVE NEGOTIATION LEGISLATION Re-Introduced

Assembly Majority Leader Ron Canestrari has re-introduced legislation (A.2474) that would permit independently practicing physicians the ability to negotiate collectively patient care terms with health insurance companies, under close state supervision. With nearly 80% of the enrollees in the commercial managed care market in New York State enrolled in just six health insurance behemoths, and most regions of the state dominated by just one or two health plans, most physicians face “take it or leave it” contracts that do not afford them any realistic ability to negotiate important plan participation terms. Enactment of this legislation is one of MSSNY’s highest priorities for the 2011 Legislative Session.

Supreme Court: Medical Residents NOT Exempt from FICA Taxes

On January 11, the US Supreme Court ruled unanimously that medical residents are not exempt from paying employment taxes under the Federal Insurance Contributions Act (FICA), and that medical residents should be considered employees when it comes to collecting Social Security taxes. This ruling in Mayo Foundation for Medical Education and Research v. United States will have a wide-ranging impact on health care and teaching hospitals and involves an estimated $700 million in employment taxes annually.

“The department certainly did not act irrationally in concluding that these doctors — ‘who work long hours, serve as high skilled professionals, and typically share some or all of the terms of employment of career employees’ — are the kind of workers that Congress intended to both contribute and benefit from the Social Security system,” said Chief Justice John Roberts, who wrote the opinion for the court.

Under the Social Security Act, medical residents were exempt from FICA taxes under an exception carved out for those performing services “in the employ of…a school, college, or university…if such service is performed by a student who is enrolled and regularly attending classes at such school, college or university.”  However, Mayo officials argued that residents fall under a Social Security tax exemption for student employees whose work is part of their education. The Treasury Department took away that exemption in 2004 for medical students who work more than 40 hours per week. Mayo Clinic officials wanted the court to overturn a federal appeals court ruling and restore the student exemption for medical residents. It also wanted a refund of the money it had withheld and paid to the IRS on its residents’ stipends during the second quarter of 2005.

In arguments before the Supreme Court, Mayo’s lawyer argued that the IRS’ decision that anyone who works over 40 hours a week at a hospital can no longer be classified as a student was arbitrary and capricious.
